RENTAL AGREEMENT, LIABILITY WAIVER, ASSUMPTION OF RISK, SAFETY RULES INDEMNIFICATION AGREEMENT

This Rental Agreement, Release of Liability, Assumption of Risk, Safety Rules & Indemnification Agreement (โ€œAgreementโ€) is entered into between Elevation Inflatables and the Customer identified on the associated invoice.

In consideration of the rental equipment described on the invoice and other good and valuable consideration, the parties agree as follows:


1. Identity of Parties

โ€œElevation Inflatablesโ€ refers to Elevation Inflatables, including its owners, officers, employees, contractors, and agents.

โ€œCustomerโ€ refers to the individual or organization listed in the โ€œRented Toโ€ section of the invoice, including the person signing this Agreement (if different), and their agents, representatives, employees, guests, invitees, and any other persons present at the event location.


2. Equipment, Payment, and Rental Term

Customer agrees to rent the equipment described on the invoice.

  • Rental fees are due as outlined on the invoice.

  • The rental period begins at the โ€œStart Timeโ€ listed.

  • Customer responsibility begins upon delivery and ends when equipment is picked up by Elevation Inflatables.

Once equipment has been delivered and accepted, no refunds will be issued if Customer elects not to use the equipment for reasons other than approved weather-related cancellation.


3. Returned Payments

If any payment is returned due to insufficient funds, Customer agrees to pay:

  • The full rental amount, plus

  • A $75 returned payment fee.

Checks are accepted only from approved businesses, churches, and schools. Personal checks are not accepted.


4. Weather Policy

Elevation Inflatables reserves the right to cancel or reschedule prior to delivery if severe weather conditions are forecasted.

Severe weather includes but is not limited to:

  • High winds

  • Heavy rain

  • Lightning

  • Thunderstorms

  • Other hazardous conditions

If severe weather occurs during the rental period, Customer must:

  • Immediately stop use

  • Remove all participants

  • Unplug the blower

  • Allow the inflatable to deflate until safe conditions return

Failure to follow weather safety procedures may result in damage fees.


5. Safety Rules & Operating Requirements

For the safety of all participants, the following rules must be enforced at all times. Customer accepts full responsibility for enforcement.

Adult Supervision

  • A responsible adult must be present and actively supervising at all times.

  • The inflatable must never be left unattended while in use or while participants are nearby.

Occupancy & Age Separation

  • Occupancy limits must be strictly followed.

  • Participants must be grouped by similar age and size.

  • Small children may not be mixed with older or larger participants.

Shoes & Personal Items

Participants must remove:

  • Shoes

  • Glasses

  • Jewelry

  • Watches

  • Badges

  • Sharp objects

  • Any item that could cause injury or damage

Food & Drink Restrictions

No food or beverages are allowed in or near the inflatable, including but not limited to:

  • Gum

  • Candy

  • Snacks

  • Ice cream

  • Popcorn

  • Cotton candy

  • Snow cones

  • Any consumable items

Participants may not enter while eating or drinking.

Prohibited Substances

The following are strictly prohibited on or near the inflatable:

  • Silly string

  • Confetti

  • Glitter

  • Face paint

  • Paint

  • Colored powder

  • Slime

  • Any staining substances

Use of prohibited materials will result in additional cleaning or damage fees.

Conduct Rules

The following activities are strictly prohibited:

  • Flips

  • Wrestling

  • Tackling

  • Climbing walls

  • Hanging on netting

  • Pushing

  • Sitting or climbing on entrance ramps

  • Climbing on top of the unit

Weather Safety

Use must stop immediately during:

  • Strong winds

  • Lightning

  • Heavy rain

  • Hazardous weather conditions

Anchoring & Blower Safety

  • Stakes, sandbags, or anchors must not be removed or adjusted.

  • The blower must remain plugged in and operating while in use.

  • If the blower stops, all participants must exit immediately.

Water Slide Rules (If Applicable)

  • Continuous water flow is required while in use.

  • Slide feet first only.

  • One rider at a time unless unit is designed for multiple lanes.

  • No diving, headfirst sliding, or standing at top platform.

Animals

No pets or animals are allowed inside or on the equipment.


6. Damage, Cleaning & Damage Waiver Terms

Customer is responsible for all damage beyond normal wear and tear.

Normal wear and tear refers only to minor deterioration from proper use.

Customer is responsible for damage resulting from:

  • Misuse

  • Prohibited substances

  • Food or drink contamination

  • Failure to supervise

  • Failure to follow safety rules

  • Vandalism

  • Theft

  • Negligence

Applicable fees may include:

  • Cleaning fees: $100โ€“$500

  • Repair fees: $200โ€“$10,000

  • Replacement value up to $10,000 if deemed beyond repair

  • Water hose damage: $20

  • Failure to protect during rain: $100 drying/cleaning fee

Damage Waiver

Any optional Damage Waiver purchased:

  • Is not insurance

  • Does not cover misuse

  • Does not cover prohibited substances

  • Does not cover food/drink contamination

  • Does not cover vandalism, theft, intentional damage

  • Does not relieve Customer of responsibility for negligence or rule violations


7. Possession, Relocation & Theft

Equipment may not be moved, sublet, transferred, or relocated without written approval.

If equipment is stolen, moved, or not returned, Customer agrees to pay:

  • Full replacement value

  • Recovery costs

Customer must immediately notify Elevation Inflatables of theft or relocation.


8. Equipment Malfunction

If equipment stops functioning:

  1. Stop use immediately

  2. Remove all participants

  3. Check blower power and air tubes

If issue cannot be resolved, contact Elevation Inflatables immediately at (910) 800-0608.

Failure to notify during rental period may void refund consideration.


9. Cancellation & Deposit Policy

  • More than 7 days prior: Full refund of $50 deposit

  • Within 7 days: $50 deposit forfeited

  • No additional cancellation fees

  • No refunds after delivery

  • Weather-related cancellations may qualify for refund or rescheduling if made prior to delivery


10. Assumption of Risk

Customer acknowledges inflatable equipment involves inherent risks including but not limited to:

  • Falls

  • Collisions

  • Slipping

  • Contact with participants

  • Equipment movement

  • Weather hazards

  • Serious injury

  • Permanent disability

  • Death

Customer voluntarily assumes all risks.


11. Release of Liability

Customer releases, waives, and agrees not to sue Elevation Inflatables for any claims arising from use of the equipment, including claims of negligence, except in cases of gross negligence or willful misconduct as limited by law.


12. Indemnification

Customer agrees to indemnify, defend, and hold harmless Elevation Inflatables from all claims, damages, losses, costs, or attorneyโ€™s fees arising from use of the equipment during the rental period.


13. Severability

If any portion of this Agreement is deemed unenforceable, the remainder shall remain in full force and effect.


14. Entire Agreement

This Agreement represents the entire understanding between the parties.

Customer acknowledges receipt of equipment in good working condition at delivery.


15. Signature Requirement

A signed copy of this Agreement is required at delivery.

By signing below, Customer certifies they:

  • Have read this Agreement in full

  • Understand they are giving up substantial legal rights

  • Agree voluntarily

  • Intend for this Agreement to be legally binding
